These Terms of Service (“Terms”) govern your access to and use of the website visatourist.org and the application-preparation and review services (the “Service”) provided by ABUNDANCE LEGAL LTD, a company registered in England & Wales (company number 16994280), registered office Suite 10448, 5 Brayford Square, London, E1 0SG, United Kingdom (“VisaTourist”, “we”, “us”, or “our”). By accessing the website, creating an order, making a payment, or otherwise using the Service, you (“you”, “the customer”, or “the applicant”) agree to be bound by these Terms. If you do not agree, do not use the Service.

1.1 Nature of the Service — Independent, Private, Non-Governmental

VisaTourist is an independent, private, third-party application-preparation and review service. We are NOT affiliated with, endorsed by, sponsored by, or operated by the U.S. government, U.S. Customs and Border Protection (“CBP”), the U.S. Department of Homeland Security (“DHS”), or any other government agency.

The U.S. Electronic System for Travel Authorization (“ESTA”) is a U.S. government program operated by CBP. The official U.S. government ESTA website is esta.cbp.dhs.gov, where you may apply directly and pay only the U.S. government fee, without using our Service and without paying our service fee. Use of our Service is entirely optional and is a convenience you choose to purchase.

1.2 What We Do

When you purchase the Service, we:

  • Collect the information required for an ESTA application through our guided intake process;
  • Review and error-check the information you provide for completeness and internal consistency;
  • Submit your ESTA application to CBP on your behalf using the information you provide; and
  • Communicate the outcome and any CBP messages back to you.

1.3 What We Do NOT Do

  • We do not make, influence, or have any role in CBP’s decision to approve, deny, or place a hold on any ESTA application. CBP alone decides.
  • We do not provide legal advice, immigration advice, or visa-eligibility determinations. We are not acting as your law firm or attorney in providing the Service. (See the separate Disclaimer.)
  • We do not guarantee that any ESTA application will be approved, processed within any particular time, or accepted by CBP.
  • We do not issue, expedite, or control travel authorizations, visas, or entry decisions.

1.4 Fees, Pricing, and Payment

The total amount you pay through the Service consists of two distinct components, itemized at checkout:

  1. U.S. Government ESTA Fee (pass-through). A U.S. government fee of US$21 per applicant is charged by CBP for the ESTA application. We collect this amount solely as a pass-through and remit it toward your CBP application. We do not retain this amount as profit, and we do not control its amount, which is set by the U.S. government and may change.
  2. VisaTourist Service Fee. Our own fee for the guided intake, review, error-checking, and submission service. This fee is what you pay us for our work and is separate from the government fee.

24-Hour Rush Tier. We offer an optional expedited service tier (the “Rush” tier) for an additional service fee. The Rush tier refers to our internal handling and submission timeframe (we prioritize preparing and submitting your application). It does not accelerate, guarantee, or influence CBP’s own processing or decision time, which is entirely outside our control.

Payments are processed by Stripe. By paying, you agree to Stripe’s applicable terms. You represent that you are authorized to use the payment method provided. All amounts are stated in the currency shown at checkout and are exclusive of any taxes unless stated otherwise.

Immediate performance / your consent. Because our work begins immediately after payment, you will be asked at checkout to expressly consent to immediate commencement of the Service and to acknowledge that, once we begin work, you lose the statutory 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. See Section 1.5 and the Refund & Cancellation Policy.

1.5 Your Obligations — Accurate Information

You are solely responsible for the accuracy, truthfulness, and completeness of all information you provide. You agree that:

  • All information you submit is true, current, and complete to the best of your knowledge;
  • You are the applicant, or you are duly authorized to submit on behalf of the applicant and have obtained their consent to provide their personal data;
  • You will promptly correct any information you discover to be inaccurate before submission; and
  • You will not use the Service for any unlawful, fraudulent, or misleading purpose.

We review for completeness and internal consistency, but we cannot verify the underlying truth of your information and are not responsible for outcomes caused by inaccurate, incomplete, or false information you supply. Providing false information to CBP may result in denial and may carry legal consequences for which you are solely responsible.

1.6 No Guarantee of ESTA Approval

ESTA approval is determined exclusively by CBP in its sole discretion. We do not and cannot guarantee approval, a particular processing time, or any specific outcome. A denial, hold, or delay by CBP is not a failure of our Service and does not by itself entitle you to a refund of the service fee, except as expressly set out in the Refund & Cancellation Policy. The U.S. government ESTA fee, once submitted to CBP, is non-refundable regardless of outcome.

1.7 Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • VisaTourist, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of travel, missed flights, lost profits, lost data, or denial/delay of entry, arising out of or relating to the Service.
  • Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount of the VisaTourist service fee you actually paid to us for the application giving rise to the claim. In no event shall our liability include the US$21 government pass-through fee, which is remitted to CBP.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including, where applicable, liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or your statutory rights as a consumer). Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the greatest extent permitted by law.

1.8 Indemnification

You agree to indemnify and hold harmless VisaTourist and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) information you provided that was inaccurate, incomplete, or false; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party. Nothing in this clause limits your non-excludable statutory rights as a consumer.

1.9 Intellectual Property

All content on visatourist.org — including text, graphics, logos, the “VisaTourist” name and marks, page layouts, software, and the design and structure of our intake and review process — is owned by VisaTourist (ABUNDANCE LEGAL LTD) or its licensors and is protected by intellectual-property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the website solely to obtain the Service for your own ESTA application. You may not copy, reproduce, scrape, resell, or create derivative works from any part of the Service without our prior written consent. All third-party names (including “ESTA,” “CBP,” and “DHS”) are the property of their respective owners and are used only for identification and descriptive purposes.

1.10 Third-Party Services and Links

The Service relies on third parties, including Stripe (payments), CBP (the ESTA program), and email/communication providers. We are not responsible for the acts, omissions, availability, or policies of these third parties. Links to external websites (including esta.cbp.dhs.gov) are provided for convenience and do not imply endorsement.

1.11 Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms, provide false information, or use the Service unlawfully. You may stop using the Service at any time. Provisions that by their nature should survive termination (including fees owed, intellectual property, limitation of liability, indemnification, and governing law) survive.

1.12 Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings in your local courts.

1.13 Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects the current version. Material changes will be posted on this page and, where appropriate, communicated to you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
