Refund & Cancellation Policy

This Refund & Cancellation Policy is part of our Terms of Service and explains when and how you may obtain a refund from ABUNDANCE LEGAL LTD (“VisaTourist”).

3.1 Two Components of Your Payment

Your payment has two parts, treated differently for refunds:

  1. U.S. Government ESTA Fee (US$21): a pass-through remitted to CBP.
  2. VisaTourist Service Fee: our fee for preparing, reviewing, and submitting your application (including any Rush-tier amount).

3.2 Immediate Service & Waiver of the 14-Day Cooling-Off Right

Our Service begins immediately after payment, at your request. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, when you ask us to begin a service within the normal 14-day cancellation (“cooling-off”) period and expressly acknowledge that you will lose the right to cancel once the service is fully performed, the statutory 14-day right to cancel does not apply once we have begun work with your consent.

At checkout you provide this express consent and acknowledgment before payment. By doing so, you agree that we may start immediately and that you give up the automatic 14-day cooling-off cancellation right. This does not remove your other statutory rights, and it does not remove our service-fee guarantee below.

3.3 Service-Fee Guarantee

We stand behind our work with a service-fee guarantee: if we are unable to submit your ESTA application to CBP, we will refund your VisaTourist service fee. This guarantee covers situations where the failure to submit is on our side.

The guarantee does not apply where we are unable to submit, or where CBP rejects/denies the application, because of: inaccurate, incomplete, or false information you provided; your failure to respond to requests for required information; ineligibility for ESTA; or other circumstances outside our control. The guarantee covers submission, not the outcome of CBP’s decision.

3.4 Government Fee Is Non-Refundable Once Submitted

Once your ESTA application has been submitted to CBP, the US$21 U.S. government fee is non-refundable, regardless of whether CBP approves, denies, or places a hold on the application. This is a U.S. government rule and is outside our control. If we are unable to submit your application and the government fee was not actually applied to a CBP submission, we will refund amounts not consumed by CBP.

3.5 Cancellation Before We Begin / Before Submission

If you contact us before we have begun work, you are entitled to a full refund. As a matter of policy, if you ask to cancel after we begin but before your application has been submitted to CBP, we will refund both the service fee and the government-fee component, because nothing has yet been remitted to CBP. Once submission to CBP has occurred, Sections 3.3 and 3.4 govern, and the US$21 government fee is non-refundable.

3.6 Rush (24-Hour) Tier

The Rush tier is an expedited service-handling option. The service-fee guarantee in Section 3.3 applies to the Rush service fee if we fail to submit. However, because the Rush tier accelerates our handling only and does not affect CBP’s processing or decision, delays or outcomes attributable to CBP do not entitle you to a Rush refund. If we fail to meet our own Rush handling commitment due to our fault, contact us and we will make it right in accordance with this policy.

3.7 How to Request a Refund

To request a refund or cancellation, email support@visatourist.org with your order reference and the reason for the request as soon as possible. Because our work begins immediately, refunds are governed by the service-fee guarantee (Section 3.3) and the cancellation terms above rather than by a fixed cooling-off window. We will review and respond, and approved refunds are issued to the original payment method via Stripe. Depending on your bank or card issuer, it may take several business days for the refund to appear.

3.8 Statutory Rights

This policy and your express consent to immediate performance do not limit any non-waivable consumer rights you may have — for example, rights that arise if the Service is not carried out with reasonable care and skill. Where mandatory consumer-protection law in your country or state of residence grants you greater rights, those rights prevail.
